Rulemaking Timeline. 

  • Tuesday, October 26, 2021: MED sends final proposed draft rules to stakeholders and posts on the MED website. 
  • Monday, November 1, 2021: Public Hearing and deadline for written comments from all stakeholders (you do NOT have to be on a work group to submit comments). The MED will present final proposed rules and hear final stakeholder comments to inform any adjustments to draft rules prior to sending them to the State Licensing Authority for final consideration.
  • On or before Wednesday, November 10, 2021: Permanent rules are adopted and announced. Note the effective date of rules will be based on statutory requirements, the earliest of which is January 1, 2022.

How to Participate:

Submit your request to be assigned to a work group: 

Stakeholders selected to serve on a rulemaking work group are expected to attend assigned meetings, engage in work group discussions, and collaborate with others to develop rule proposals, conduct research, and present relevant information. 

Interested parties can submit their request to serve on a work group by completing this Google Form

Before you submit your request, please confirm your availability on the above dates prior to applying to serve on a work group. 

When identifying parties to serve on rulemaking work groups, the Division’s goal is to ensure work groups represent a diversity of perspectives and subject matter expertise and/or experience or knowledge relevant to the subjects under consideration. And while selected work group members will be assigned to serve as the primary participants in scheduled work group meetings, each meeting will provide opportunities for public comment by all interested parties in attendance. 

Attend meetings and participate during the public comment period: 

All members of the public can attend work group meetings, may provide oral comment during the public comment period for each meeting, and may submit written comments on proposed rules. Whether or not you apply to serve on a work group, your feedback will be used to inform work group agenda items, discussions, questions, and the Division’s proposals.

Next Steps:

Unless otherwise announced, all work group meetings will be held remotely and links to access each work group will be posted in advance on this webpage

Work group meetings are open to the public and all interested parties can take an active role in the process by attending and participating in work group meetings and by submitting written comments on proposed rules. 

For work groups with assigned members, the Division will notify assigned members via email on or before July 30, 2021. A list of assigned members and agenda for each work group will also be published on this webpage prior to each public meeting. The Division may also identify needs to substitute or add members to established work groups. 

The Division may choose to facilitate a work group meeting without assigned members. In such a case, work group participation will be open to all attendees. These details and any updates will be published on this webpage. 

Additionally, we recognize that HB21-1301 outlines two additional workgroups, one focused on cross-pollination and another focused on tax and wholesale cultivation. These two work groups require coordination with the Department of Agriculture and the Taxation Division, and additional information is forthcoming. The Division will provide updates on these work groups via the MED Stakeholder listserv (link to subscribe below).
