March 16, 2021 at 9:00 AM: The Motor Vehicle Dealer Board held an Emergency Rulemaking Meeting in response to the COVID-19 pandemic promulgating two emergency rules/regulations in accordance with section 24-4-103(6)(a), C.R.S., permitting motor vehicle dealers, used motor vehicle dealers, powersports vehicle dealers and used powersports vehicle dealers to continue retail sales transactions to the citizens of Colorado during the pendency of the COVID-19 emergency.

Adopted Emergency Rule 44-20-402(17)-COVIDMay 1, 2020, at 9:00 AM: The Motor Vehicle Dealer Board held an Emergency Rulemaking Meeting in response to the COVID-19 pandemic.
On April 26, 2020, Governor Jared Polis issued Executive Order D 2020 044, Safer at Home, continuing stay-at-home requirements for vulnerable individuals and permitting the limited reopening of postsecondary institutions and certain business operations due to the presence of coronavirus disease 2019 in Colorado. Pursuant to Governor Polis' directive in Executive Order D 2020 044, the Colorado Department of Public Health and Environment issued Public Health Order 20-28 ("PHO 20-28") on April 26, 2020, with an effective date of April 27, 2020, which superseded and replaced PHO 20-24.
In light of the above-referenced orders, the Colorado Motor Vehicle Dealer Board will consider the revision of two emergency rules/regulations in accordance with section 24-4-103(6)(a), C.R.S., that were promulgated on April 3, 2020:
Emergency Rule 44-20-102(22)-E
Emergency Rule 44-20-402(17)-EUp until May 1, 2020, all Colorado motor and powersport vehicle dealerships may conduct motor and powersport vehicle sales only online or by appointment as authorized under emergency rules set forth by the Motor Vehicle Dealer Board on April 3, 2020. Approved Emergency Rules 1 CCR 205-1 and 1 CCR 205-2, outlined in AID Bulletin 20-01,in effect until Friday, May 1, 2020, at which time retail sales, with restrictions, may begin again under Public Health Order (PHO) 20-28.
Beginning on May 1, 2020, motor and powersport vehicle dealerships may open under the state's guidance for retail locations under PHO 20-28. Dealerships must follow state guidelines for social distancing and health and safety standards, unless the city or county, in which the dealership operates, has implemented more restrictive approved variances or extended health orders.

On March 25, 2020, Governor Polis issued Executive Order D 2020-017, "Ordering Coloradans to Stay at Home Due to the Presence of COVID-19 in the State" and the Colorado Department of Public Health and Environment (CDPHE) issued Amended Public Health Order 20-24, "Implementing Stay at Home Order Requirements." Subsequently, on March 27, 2020, the Colorado Department of Health and Environment issued a Second Updated Public Health Order 20-24.In light of the above-referenced orders, the Colorado Motor Vehicle Dealer Board will consider the promulgation of two emergency rules/regulations in accordance with section 24-4-103(6)(a), C.R.S., that would permit motor vehicle dealers, used motor vehicle dealers, powersports vehicle dealers and used powersports vehicle dealers to continue retail sales transactions to the citizens of Colorado during the pendency of the COVID-19 emergency.
