Senate Bill 24-076 and fees effective Aug. 7, 2024

Senate Bill 24-076 “Streamline Marijuana Regulation” was effective at 12:01 a.m. on Aug. 7, 2024. As a result of this bill, the Division implemented emergency rules to align with the bill's effective date. Please note that the Division is working on permanent rulemaking, which will impact some of the items below. More information can be found on the MED’s 2024 rulemaking webpage
 

The following changes were effective at 12:01 a.m. on Aug. 7, 2024: 
Fees 

  • Increased by about 5% and rounded reflecting inflation 
  • Modified to reflect the new biennial licensing requirements

Two-year license terms

  • RMB & CBO licenses will now be valid for two years, instead of the current one-year term. This includes delivery permits.
  • Please see the new fee schedule (and two-year license terms) beginning Aug. 7, 2024.

Other Information for Applicants: 

  • In compliance with law and in accordance with Senate Bill 24-076, any applications submitted Aug. 7, 2024 and after will reflect a two-year license term (and equivalent fee). 
  • Any applications submitted Aug. 6, 2024 and before reflect a one-year license term (and equivalent fee).

Frequently Asked Questions

Can I apply for a 1-year license?
As a result of SB 24-076, effective August 7, 2024, license terms are for 2 years, whether an initial license or a license renewal. Providing the option for a 1-year license will require a statutory change. 
Can I pay half now, and half later? Can I make a partial payment?
Not at this time. The MED is evaluating other options as part of its permanent rulemaking process. Please see the 2024 rulemaking webpage for more information.
What about Social Equity applicants?
The discount for Social Equity feeds (relative to the standard fee) is the same discount it was last year. The Division is actively exploring opportunities to incorporate additional fee relief for Social Equity licensees. 
What happens if I applied on August 7, 2024 instead of August 6, 2024?
Initial and renewal applications submitted on and after the effective date of August 7, 2024, will be charged a two-year license fee and provided a two-year expiration upon approval or issuance.
Will Transporter licenses have their renewals extended, or will they keep the same two-year renewal period?
Transporter licenses will keep the existing two-year license term.
What is the Division doing to reduce costs and improve processes?
The Division continues to implement cost-cutting measures, which include, but are not limited to reducing lease space, closing long-standing regional offices and maintaining lower staff levels.
How many employees does MED have currently?
The Division is allocated 156 full-time employees (FTE), but has intentionally limited staffing levels to 105 FTE. MED headcount (FTE) is down 14% as of Aug. 7, 2024, compared with June 2021.
