Permanent Rules Adopted, October 7, 2020

Permanent Rulemaking Hearing held Tuesday, September 22, 2020.

At the hearing, the Division presented the final proposed rules for the State Licensing Authority's consideration via a virtual meeting hosted on Zoom and open to the public. Those participating were able to provide public comment, and written comments were accepted until 5:00 PM, September 22, 2020.

Unless otherwise announced, all workgroup meetings will be held remotely and links for the work groups will be posted in advance on this page.

If you are interested in serving on one of the work groups, please submit an online application no later than Friday, July 10, 2020. Prior to submitting your request, please confirm your availability on the assigned dates and times noted above. As a panel member, you will be expected to participate in the discussion, present data, and other materials relevant to the subject(s) of the work group, and assist with drafting proposed rules. The Division may seek to amend the composition of any workgroup based on the subject matter of each meeting and the ability to accommodate alternative or additional participants.

Workgroup meetings are open to the public and all interested parties can take an active role in the process by attending workgroup meetings, offering oral comments during the public comment portion of the meetings, and by submitting written comments on proposed rules.

The Marijuana Enforcement Division is seeking stakeholder feedback for rulemaking specific to the SB19-224 Accelerator Program. In particular, we are asking for your input on an additional Proposed Separate Premises Model.

We also understand that there are ongoing conversations regarding social equity initiatives that may be considered during this 2020 legislative session. Please know that we have an interest in engaging in and supporting these discussions and ensuring such efforts inform our continued development of the Accelerator Program.

We appreciate the opportunity to continually engage in these discussions with you. We are listening and eager for your input. To support efforts to limit the spread of COVID-19 and to comply with public health social-distancing guidelines and orders, along with the desire to ensure sufficient opportunities for stakeholder participation in the Accelerator Program rulemaking process and support the success of the Accelerator Program, the permanent rulemaking, tracking no. 2020-00115 is terminated. Therefore, the permanent rulemaking hearing scheduled for March 30, 2020, is canceled. The State Licensing Authority will issue a new notice of permanent rulemaking as soon as possible to inform stakeholders of opportunities to engage in the permanent rulemaking process for the development of the Accelerator Program and other rules.
