The Colorado Marijuana Code requires the State Licensing Authority to establish fees that “reflect the actual direct and indirect costs of the state licensing authority in the administration and enforcement” of the Marijuana Code. 44-10-801(3)(b), C.R.S. The State Licensing Authority has not engaged in a comprehensive fee review and fee setting initiative since first standing up its program almost a decade ago. Since that time, the regulated marijuana program and industry has evolved and the work of the Marijuana Enforcement Division and State Licensing Authority has become more complex as a result of legislative and regulatory changes, including the introduction of publicly traded companies into the licensing scheme, new business license types, and additional resource needs to monitor and respond to testing practices.
Over the last two years, MED has messaged the likelihood of a negative Marijuana Cash Fund balance, which occurred this year. In order to maintain compliance with the statutory requirement to establish fees that reflect the actual direct and indirect costs of administering and enforcing the regulated marijuana program, the State Licensing Authority, in coordination with MED, is re-initiating rulemaking to review and set fees.
Attend the stakeholder meeting and participate during the public comment period:
The Colorado Department of Revenue’s Marijuana Enforcement Division (MED) will host a stakeholder meeting on June 5, 2023 from 3:00 - 4:00 pm to present a proposed plan for fee setting, proposed fees, and to gather initial stakeholder feedback. The stakeholder meeting will be at the Department of Revenue at 1707 Cole Blvd., Suite 300, Lakewood, CO 80401 in the Red Rocks Conference Room. There will also be a virtual option (see Zoom information below).
All members of the public can attend the stakeholder meeting and may provide oral comment during the public comment period.
