Dear Liquor Industry,
On March 10, 2015, the Federal Alcohol and Tobacco Tax and Trade Bureau decided to approve labels for powdered alcohol. This approval will allow powdered alcohol to be sold in Colorado, but current rules are not adequate to address all the challenges that come with the proper and appropriate regulation of powdered alcohol.
The Division has supported HB15-1031, which if passed, mandates the Division to promulgate rules for the regulation of powdered alcohol. In response to the current TTB decision and in light of HB15-1031, the Colorado Liquor Enforcement Division will create a working group to review and develop rules to address all concerns, issues, licensing and enforcement of powdered alcohol.
If you wish to be a member of the working group, please submit your request. The Division has not decided yet if emergency rules are needed or if the rules can be developed through the usual rule making process that starts in May. Members selected to be on the working group will be notified of dates and location at least 2 weeks in advance.
