Dear Liquor Stakeholders,
Recently, the Division has received an increased number of inquiries regarding Sales Rooms’ abilities to provide takeout and/or delivery services to customers. This bulletin is designed to clear up any confusion in the consistency of investigative application throughout the state.
Sales Rooms licensed pursuant to 44-3-402 or 44-3-407 C.R.S. have traditionally had the ability to provide alcohol beverages that they are licensed to sell to customers for consumption off the licensed premises in authorized sealed containers (See 44-3-103(49), C.R.S.). The passage of House Bill 21-1027 did not change that statutory ability and Sales Rooms may still offer alcohol beverages for “takeout” to patrons of their establishments in this way, as they have always been allowed to do.
House Bill 21-1027 gave Sales Rooms a time-limited ability to offer alcohol beverages for delivery. This ability for Sales Rooms was repealed on January 1, 2022, and they are statutorily no longer able to offer alcohol beverages for delivery to customers’ homes off the licensed premises.
Please remember that all alcohol beverages offered for either takeout or delivery from your licensed premises must comply with the container and safety requirements detailed in Regulation 47-1101, 1 CCR 203-2.
