BULLETIN 20-26 Guidance on Sealed Container Sales for Hotel Licensees

TheLiquorEnforcementDivision(LED) isissuingthisbulletininorder toprovideclarifyingguidanceonthesale                  of alcohol beverages in sealed containers by hotel licensees who are licensed under 44-3-413, C.R.S

DuetotheenactmentofSB20-213,hotel licenseesmaysellbeveragealcohol insealedcontainersfortakeoutand                   deliveryfromtheir licensedpremises.DuetotheCOVID-19pandemicandtheassociateddifficultiesithascaused,                 LEDisallowinghotel licenseestosellsealedalcohol toguestsfromalocationonthelicensedpremisesotherthan                    thehotel restaurant/barwherealcoholbeveragesaretypicallyserved.Thisallowanceis,at thistime, temporaryin                 natureandofferedasareliefmeasureaswearehearingthatmanyHotelrestaurants/barsarenotoperableduringthe                    pandemic and looking for solutions as to how to ensure access to alcohol beverages for their guests at this time. 

In order to take advantage of this temporary ability, the following guidelines must be followed

  • Thearea fromwhichalcohol beveragesareofferedfor to-gopurposesmust be locatedon the licensed                 premises;  
  • The alcohol beverages offeredmust be stored in a secured area that ismonitoredby a live person                  (virtual/camera monitoring is not acceptable); 
  • Guestsmust have their identificationcheckedandmustbeassessedfor intoxicationbyahotelemployee                prior tothealcoholbeingremovedfromthesecuredarea,toensurethattheguestsareoflegaldrinkingage                    and are not visibly intoxicated;  
  • Warning labels and containers must adhere to the parameters of Regulation 47-1101, 1 CCR 203-2; and 
  • Thehoursduringwhich to-gosalesof alcohol beveragesarecompletedarelimitedtotakeouthoursfor                 Restaurantsbasedonthecounty’sstatusontheCOVID-19dial.Alcoholbeveragesofferedforsalethrough                roomservicearestillpermitteduntil2:00a.m., regardlessofcountyhealthlevelstatusontheCOVID-19 dial.

TheDivisionwill reviewthistemporaryallowanceeverythirty(30)days.TheDivisionreservestherighttoamend                  orwithdrawindustrybulletinsat any timebutwill try togiveasmuchforewarningaspossiblebeforeanysuch                    amendment or withdrawal.
