REFERENCE: RECODIFICATION OF THE LIQUOR AND TOBACCO STATUTES

COLORADO LIQUOR ENFORCEMENT DIVISION (LED) 

I. General

Pursuant to recent legislation: 

  • The Colorado Beer Code,  
  • The Colorado Liquor Code,  
  • The Liquor – Special Event Permits Code,  
  • The Regulation of Tobacco Sales to Minors Code, and  
  • The LED and State Licensing Authority – Funding provision,  

will be recodified effective October 1, 2018.  These statutes will move from Title 12 and Title 24 of the Colorado Revised Statutes (C.R.S.) to a new Title 44 of the C.R.S. 

This legislation also “cleaned up” some specific citations that were not whole numbers.  For example, the definition of “alternating proprietor licensed premises” is currently cited at subsection 12-47-103(2.5), C.R.S.  Upon recodification, the definition of “alternating proprietor licensed premises” will be cited at subsection 44-3-103(3), C.R.S.  Subsequent citations are changed accordingly. 

This legislation did not change substantive provisions of the statutes.  Any substantive changes to these statutes made during the 2018 Legislative Session 

Liquor and Tobacco Recodification were made pursuant to other bills.  The LED will host public training courses after the conclusion of the 2018 Legislative Session to train on any substantive changes made to relevant statutes.   

The LED will begin the effort to change statutory citations within the Colorado Liquor Rules and will submit notifications regarding these changes as they become effective in the future. 

Questions

How could this change affect you?   

All of the legal citations for liquor and tobacco statutes will change and you may need to change forms, pamphlets, educational materials, and any other documents that have a liquor or tobacco statutory reference. 

When does this take effect? 

The recodifications are effective on October 1, 2018. 

What will the new numbers be? 

A link to the bills can be found below.  In addition, the LED will provide updates during the summer of 2018. 

Were there any substantive changes? 

No – just re-numbering. 

II. Recodification of the Beer Code, the Liquor Code, and the Special Event Liquor Permits Code 

On April 23, 2018, Governor Hickenlooper signed HB 18-1025.  This bill recodifies:

  • The Colorado Beer Code  

     From Article 46 of Title 12 to Article 4 of Title 44 

  • The Colorado Liquor Code 

     From Article 47 of Title 12 to Article 3 of Title 44 

  • The Colorado Special Event Liquor Permits Code  

     From Article 48 of Title 12 to Article 5 of Title 44

III. Recodification of the Regulation of Tobacco Sales to Minors Code 

On March 15, 2018, Governor Hickenlooper signed SB 18-036.  This bill recodifies: 

  • The Regulation of Tobacco Sales to Minors Code

     From Article 35 of Title 24 to Article 7 of Title 44

IV. Recodification of the Liquor Enforcement Division and State Licensing Authority – Funding Provision 

On March 7, 2018, Governor Hickenlooper signed HB 18-1026.  This bill recodifies: 

  • The Liquor Enforcement Division and State Licensing Authority – Funding Provision

     From Article 35 of Title 24 to Article 6 of Title 44
