The Division has received the following comments via the Liquor Enforcement Division Rulemaking email. The Division will respond to certain parties’ comments should the Division implement their recommendations into the rule.

As briefly discussed at the State Tobacco Rules Working Group Session #3 Rule Update meeting on September 10, 2025, below is a proposed edit to Rule 7-100(K):

“RETAIL LOCATION” MEANS A LOCATION THAT ALLOWS FOR COMMERCIAL USE. A RETAIL LOCATION CANNOT BE A RESIDENTIAL LOCATION.

Mr. Sandberg,

Thank you for your comment. The Division plans on moving forward with its language, which states that the location "means a commercial location that allows a customer to enter the

location." The Division believes that this language ensures that the location is a commercial space without having to account for zoning law complexities in different local jurisdictions.
