Off Premise Permit - Auto Industry Division

The Dealer Board recognizes Two (2) Classes of Off Premise Permits based upon specific sales-related conditions and restrictions:

A Class one is a Limited Sales Activity Off-premise Permit.  The following conditions and restrictions apply to this permit:

• Licensed salespersons or owners authorized to sell must be present at the off-premise location at all times when the public is present; and,
• Licensed salespersons or owners authorized to sell may negotiate the terms of a sale at the off-premise location; and,
• The parties shall not execute sales-related documents at the off-premise location, but must return to the dealership to execute any sales-related documents.

A Class Two is a Full Sales Activity Off-premise Permit. The following conditions and restrictions apply to this permit:

• Licensed salespersons or owners authorized to sell must be present at the off-premise location at all times when the public is present; and,
• Licensed salespersons or owners authorized to sell may negotiate the terms of a sale at the off-premise location; and,
• The parties may execute sales documents at the off-premise location.

Off Premise Permit

1. Complete and submit the Off-Premise Permit Application (DR 2043) form.

2. This form must be signed by an: Owner, Partner, LLC Member/Manager, or Corporate Officer (president, vice president, secretary or treasurer).

3. The title of the person signing the form must be provided and form must be dated.

4. The board issues an Off Premise Permit for a restricted number of days. The applicant must abide by the restricted number of days:

• Up to six calendar days from start to finish is allowed for an off-premise permit, except as provided below;

• Up to twenty calendar days from start to finish is allowed for an off-premise permit for the National Western Stock Show, the Colorado State Fair, the Greeley Stampede, or the Denver Auto Show.

• The board may, in its informed discretion, approve consecutive off-premise permits for a recurring special event at the same location for a limited period of time.

5. The Off Premise Permit must be submitted Fourteen (14) days before the event.

• By no later than fourteen calendar days prior to the off-premise event, a motor vehicle dealer must submit a completed application form for an off-premise permit.  The board shall reject for filing any application for an off-premise permit that is not accompanied by a remittance in the full amount of the fee for the permit.  The board may reject for filing any application that does not completely satisfy the requirements of the application form and its instructions.

• A motor vehicle dealer may occasionally display vehicles without an off-premise permit at an event or location away from the dealership.  Sales activity is prohibited.  However, a person may be present to provide security or to distribute information about the dealership and its vehicles.

• A late fee will be assessed, if the application is not submitted Fourteen (14) days before the event.

6. Consecutive Days for the same location are not allowed.

7. Sunday closing law - Any date falling on a Sunday subjects the applicant to the provisions of the Sunday closing law listed in the Statutes and Regulations section below. This permit should NOT be construed as permitting Sunday sales in violation of that law.

8. Pay Fee(s) - Check should be made payable to the Department of Revenue. All fees are subject to change July 1st of every year. See button labeled $ Fees

9. Incomplete Applications - Failure to complete all sections of the application may result in a rejection or delay in processing

10. Additional Requirements

• All documents submitted must be on 8.5” x 11” size paper.

• Do not submit legal size copies.

• Do not submit double sided copies.

• Do not staple documents.

Off Premise Permit

The Auto Industry is now accepting applications online.

To apply online, you must first obtain a registration code. Registration codes can be obtained by any of the following methods:

• During your renewal period, your renewal and a letter announcing the new online process will be mailed to you. The registration code is printed on the renewal. Safeguard this number and keep it for future reference.
• You may request a Registration Code by emailing: dor_aidlicensing@state.co.us.
  • In the subject line please enter: Registration Code
• Call the Auto Industry Division: (303)205-5604.

If your license is listed as "Inactive" or your renewal is in "30-day grace period," you must first renew your license before you can take any other actions on it.

The Auto Industry Division has created a training video that is available here. 

• Approved permits will be mailed to the Dealership, or if presented in person, may be approved at the Auto Industry Division office.

• The Auto Industry Office location may be found in the Contact Us section of the website.

•  Once the Off Premise Permit is approved, the approved permit must be posted for inspection at the sale location.
